Terms of Service

Effective Date: March 2025

1. Acceptance of Terms

By engaging BlockWise Forensics & Recovery Ltd ("BlockWise") for wallet recovery, forensics, or consultancy services, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. No Guarantee of Recovery

Cryptocurrency recovery is probabilistic. While we utilize state-of-the-art GPU clusters and forensic methodology, BlockWise does not guarantee the successful recovery of your funds.

Payment of the "Resource & Attempt Fee" covers the engineering time, electricity, and hardware usage required to attempt the recovery, regardless of the outcome.

3. Fees and Payments

  • Feasibility Report: Free of charge.
  • Resource & Attempt Fee: A fixed upfront fee (e.g., $199 - $1499 NZD) based on your selected service tier. This fee is non-refundable.
  • Success Fee: A percentage of the recovered funds (8% - 12%) payable only if access is successfully restored.

If recovery is successful, BlockWise reserves the right to deduct the Success Fee programmatically during the transfer of funds to your new secure wallet, or require payment before releasing the recovered keys.

4. Client Warranties (KYC & AML)

You warrant and represent that:

  • You are the legal owner of the wallet/funds in question, or you have explicit legal authority to act on behalf of the owner.
  • The funds are not derived from illegal activities (Money Laundering, Terrorism Financing, Fraud).
  • You will provide accurate identification documents for Know Your Customer (KYC) verification before we commence work.

BlockWise reserves the right to report any suspicious activity or attempts to recover stolen wallets to New Zealand Police or relevant international authorities.

5. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • BlockWise is not liable for data loss caused by pre-existing hardware damage (e.g., degraded flash memory on Trezor/Ledger devices).
  • Our total liability for any claim arising out of these terms shall not exceed the total amount of the "Resource & Attempt Fee" paid by you.

6. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
